End-User Privacy Policy

1. Purpose of this document

This Privacy Policy (hereinafter referred to as “Policy”) outlines the terms and conditions on how the data subjects’ (hereinafter referred to as “Users” or “you”) personal or anonymous information is processed. Please read these terms and conditions carefully!

This Privacy Policy applies to the data collected by NNG Software Developing and Commercial Limited Liability Company (registered office: Szépvölgyi út 35-37., 1037 Budapest, Hungary, company registration number: 01-09-891838, EU VAT id: HU13357845, hereinafter referred to as “NNG”) in relation to the operation of the iGO Primo applications for iOS available in the App Store and for Android available in Google Play Store (hereinafter respectively referred to as “Application”).

2. Definitions

In the context of this Privacy Policy:

Anonymous data: information that is not associated with or linked to your personal data; Anonymous data does not permit the identification of individual persons;

Unique Device Identifier: means an identification code randomly generated for each device.

3. Purpose of the data processing and scope of the processed data

While using the Application, we collect the following data that qualifies as personal data based on the Act CXII of 2011 on the Right of Informational Self-Determination and on Freedom of Information of Hungary („Data Protection Act”):

3.1. Location data

As you use the Application we collect the following location and route information sent by your device on which the Application is installed and activated:

  • GPS signals;

  • speed of the vehicle;

  • heading of the vehicle;

  • location of the vehicle.

The above data is collected by a backend service and gathered from connected devices which use NNG’s navigation software. The connected navigation device periodically sends GPS-based data to NNG’s server. The data is sent on-the-fly, therefore a continuous internet connection is required. If there is no internet connection (e.g. due to bad signal strength), the logs generated by the client device will be uploaded to NNG’s server once there is a connection, but only those pieces of data will be forwarded to the provider that are not older than 5 minutes.

We use this information to

  • improve the quality and enhance your experience with the Application;

  • to create aggregated and anonymous data;

  • to comply with any applicable law and assist law enforcement agencies under any applicable law, if required or requested and such request meets the applicable legal standards and procedures, as NNG may by obligated by mandatory law to disclose your personal data to certain authorities.

We use a randomly attributed Unique Device Identifier in connection with your location data and logs. Such identifiers are processed anonymously. We do not use this information to identify you personally.

NNG may use such anonymous, statistical or aggregated information (including anonymous location information), in a form that does not enable the identification of a specific user and the information cannot be linked back to you, by posting, disseminating, transmitting or otherwise communicating or making available such information to map and service providers, partners and any other third parties.

The provided data is accessible to the following persons:

  • NNG’s employees and managers involved in the execution of the purpose of the data collection;

  • IT specialists performing a variety of IT tasks related to the operation and maintenance of NNG’s computer system.

5. Legal basis of data processing

The legal basis of data processing is your consent given pursuant to Section 5 (1) a) of the Data Protection Act.

6. Consent to the provisions of this Policy

By clicking on the approval button you expressly and voluntarily give your consent to NNG to process your personal data according to the provisions of this Policy and in line with the data protection rules of the law. Users’ consent is required in every 12 months for the data processing. In case User does not provide/renew his/her consent his/her personal data cannot be further processed.

7. Duration of data processing

7.1. Personal data collected in line with this Policy is processed for a period set out in section 3.1 of this Ploicy.

7.2. You may revoke your consent any time by changing your preferences within the Application’s settings.

8. Information on rights and on seeking remedy

8.1. User may request the following from NNG as data controller:

  • information on the processing of his/her personal data;

  • rectification of the personal data and

  • deletion or blocking of personal data (unless processing of the personal data is mandatory).

8.2. You are entitled to request information on the data processing carried out by NNG, especially information as to what personal data is stored relating to you, the sources from which they were obtained, the purpose, grounds and duration of processing, if your personal data is made available to others, the legal basis and the recipients, and any data protection incident in relation to your personal data by sending an email to press@nng.com or a mail to NNG’s address (H-1037 Budapest, Szépvölgyi rd. 35-37.). NNG provides information on personal data processing within 25 days upon submission of the respective request, in writing. You may also can request the correction or blocking of your personal data.

8.3. In case the personal data is inaccurate, you may request NNG to rectify suck data provided that the correct data is at NNG’s disposal.

8.4. Your data may be deleted upon your request. Request for data deletion may be submitted to NNG by using the email or postal address specified below. NNG also deletes all stored personal data of which knowledge is no longer necessary for the performance of the purpose or if the storage of the personal data is inadmissible due to legal reasons. Personal data that is subject to legal obligation to preserve is not affected.

8.5. Personal data shall be blocked instead of being deleted if so requested by User as data subject, or if there are reasonable grounds to believe that deletion could affect the legitimate interest of the User.

8.6. Please be informed that your data will not be deleted if the processing thereof is required by law.

8.7. You may lodge a complaint about the processing of your personal data to the National Authority for Data Protection and Freedom of Information (Nemzeti Adatvédelmi és Információszabadság Hatóság, hereinafter referred to as “NAIH”; address: H-1125 Budapest, Szilágyi Erzsébet fasor 22/C.; postal address: 1530 Budapest, Pf. 5.; 5 phone: +36-1-391-1400; facsimile: +36-1-391-1410; email: ugyfelszolgalat@naih.hu). if in your opinion an infringement occurred in relation with the data processing or exercising of your right for information in relation to personal data, or if there is imminent danger of such infringement.

8.8. Independently from lodging a complaint to NAIH, in the event of the infringement of your rights You may turn to court pursuant to the provisions set forth in the Privacy Act. Upon your decision the procedure might be launched before the tribunal in whose jurisdiction you are domiciled or you have a temporary address. Prior to initiating a legal procedure, it might be useful to discuss the complaint with NNG.

8.9. Your detailed rights and remedies are set out in the subsections 14-18 and 21-23 of the Privacy Act.

8.10. Requests and objections shall be submitted to Data Controller’s customer care via email to https://nng.com/contact-us-igo-navigation-applications.

9. Availability and amendment of this Policy

NNG may from time to time unilaterally change the terms of this Policy. We recommend that you re-visit the site where this Policy has been made available from time to time. If you do not agree with any of the amended terms, you must avoid any further use of the Application.
